Terms of Service

These Terms of Service ("Terms") govern your use of Botivio and the website botiviochat.com (the "Service"), operated by Botivio ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Your Account

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to keep it current.

2. Credits, Payments & Free Tier

The Service uses a credit-based system. New accounts receive a limited number of free credits. Additional credits may be purchased as one-time packs that never expire. Each message you send generally consumes one credit. A fair-use cap of 2,000 credits per calendar month applies to all accounts; usage beyond the cap may be paused until the next month.

Payments are processed securely by our payment provider (Base44 Payments, powered by Wix Payments) on secure checkout pages. One-time pack purchases are final and non-refundable except where required by applicable law. Prices and pack sizes may change; any change does not affect credits already purchased. If you believe you were charged in error, contact us as described below.

3. Referral Program

You may invite others using your referral link. When a new user signs up through your link, both you and the referred user may receive bonus credits. We may modify or end the referral program, including bonus amounts, at any time. Abuse of the program (e.g., self-referrals, fake accounts) will result in forfeiture of bonus credits and may lead to account termination.

4. Acceptable Use

You agree not to:

  • Use the Service for unlawful, fraudulent, or harmful purposes;
  • Generate content that is illegal, infringing, harassing, or that violates others' rights;
  • Attempt to reverse-engineer, scrape, or overload the Service;
  • Resell or redistribute access without our permission;
  • Use the Service to build competing AI products.

5. AI-Generated Content

Responses are generated by AI models and may be inaccurate, incomplete, or misleading. The Service does not constitute professional advice (legal, medical, financial, or otherwise). You are responsible for reviewing and verifying any output before relying on it. We are not liable for decisions you make based on AI-generated content.

6. Files & User Content

You may upload files to provide context for your conversations. You retain ownership of your content. By uploading, you grant us a limited license to process and store your files solely to provide the Service. You represent that you have the right to upload your files and that they do not violate law or third-party rights. Do not upload sensitive personal data (e.g., government IDs, passwords, health records).

7. Intellectual Property

The Service, including its design, branding, and software, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or proprietary content beyond what is needed to use the Service.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee uninterrupted, error-free, or secure access.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the three months preceding the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your account if you violate these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ends; unused credits may be forfeited.

11. Changes to These Terms

We may update these Terms from time to time. We will notify significant changes through the Service or by email. Continued use after changes take effect means you accept the updated Terms.
